Course overview

The statutory guardianship has replaced the former incapacitation and today represents a modern, individually tailored support system for people with limited decision-making capacity. The focus is on maintaining self-determination while ensuring legally secured support in important areas of life. In this training, you will receive a structured introduction to the fundamentals of guardianship law. You will learn how legal guardianship is structured in today's system, what tasks guardians can take on, and where clear legal boundaries exist. It will become clear how support can be organized without unnecessarily restricting the independence of the affected individuals. A key focus is on the most important legal precautionary documents. You will engage with powers of attorney, advance directives, and living wills, and learn about the significance of these documents for self-determination and legal security. Additionally, fundamental aspects of contract law in the context of care and support will be addressed. Furthermore, the training provides insights into special legal constellations, such as those related to guardianship, pregnant women, or parents under legal guardianship. The rights of people with disabilities and basic regulations of the Infection Protection Act will also be placed in a practical context. The goal of the training is to present legal fundamentals in an understandable manner and to highlight their significance for the care and counseling of people in need of support. Upon completion, you will have a solid foundational knowledge of guardianship law and will be able to better classify legal contexts in caregiving and counseling.
