§ 1 Scope
These General Terms and Conditions ("T&Cs") govern the use of the website bildungly.de and the related AI-powered upskilling advisory service (the "Service") provided by Sravan Vankam, Blissestrasse 41, 10713 Berlin ("Bildungly", "we"). By using the Service you agree to these T&Cs. Deviating or conflicting general terms of the user shall not apply unless we have expressly agreed to them in writing.
§ 2 Service description
Bildungly is a free, independent information and orientation platform that helps learners in Germany discover continuing-education courses, understand AZAV/Bildungsgutschein funding options and obtain personalised recommendations through an AI assistant. We are not a training provider (Bildungsträger), not certified under AZAV, and not affiliated with the Bundesagentur für Arbeit. Course bookings, contracts and funding decisions are concluded exclusively between the learner, the respective training provider and the responsible authority.
§ 3 No legal, tax or career advice
Information provided by the Service — including AI-generated answers, course listings, funding summaries and PDF learning paths — is for general orientation only and does not constitute legal advice, tax advice, official career counselling (Berufsberatung) or a binding funding promise. Always verify details directly with the training provider, the Agentur für Arbeit, the Jobcenter or another competent authority before making decisions.
§ 4 Use of AI-generated content
The Service uses large language models to generate responses. Outputs can be incomplete, outdated or inaccurate ("hallucinations") and may not reflect the current curriculum, pricing or funding eligibility of any course. You are responsible for critically reviewing AI outputs before relying on them. We do not warrant that AI-generated content is fit for any particular purpose.
§ 5 Registration and account
Core features of the Service can be used without registration. Where an account or sign-in is offered, you must provide accurate information, keep your credentials confidential and notify us of any unauthorised use. We may suspend or delete accounts that violate these T&Cs.
§ 6 Acceptable use
You agree not to: (a) use the Service for unlawful purposes; (b) submit personal data of third parties without a legal basis; (c) attempt to reverse-engineer, scrape at scale, overload or disrupt the Service; (d) bypass technical protection measures; (e) use outputs to train competing AI models; or (f) misrepresent AI-generated content as official advice from an authority or training provider.
§ 7 Intellectual property
All content of the Service — including text, design, logos, software and the "Bildungly" name — is protected by copyright and other IP rights and remains the property of Bildungly or its licensors. Course data displayed on the Service may belong to the respective training providers. You receive a non-exclusive, non-transferable, revocable right to use the Service for your personal, non-commercial upskilling purposes.
§ 8 Availability and changes
The Service is offered free of charge and on an "as is" basis. We do not guarantee uninterrupted availability and may modify, restrict or discontinue features at any time, in particular for maintenance, security or legal reasons.
§ 9 Liability
We are liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz). For slight negligence we are only liable for the breach of a material contractual obligation (Kardinalpflicht), and such liability is limited to the foreseeable, typical damage. Any further liability — in particular for funding decisions of authorities, decisions of training providers or for damages resulting from reliance on AI-generated content — is excluded to the extent permitted by law.
§ 10 Data protection
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). Details on cookies, analytics (PostHog) and your rights are available in our Privacy Policy.
§ 11 Final provisions
These T&Cs are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of the country in which the user has their habitual residence remain unaffected. The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Should any provision of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected.
